Sales and delivery conditions
When purchasing goods from Norlux AS, the customer accepts the following conditions:
General payment terms
All orders, confirmed and unconfirmed, are executed at the prices in effect on the day of delivery. Norlux AS reserves the right to change prices, conditions, designs, dimensions and designations.
If a separate agreement has been entered into regarding price, Norlux AS shall always be able to adjust prices proportionately as a result of changing exchange rates and raw material prices.
For all orders less than NOK 1,500,- net invoiced, a processing fee of NOK 300,- will be charged upon shipment.
The invoice is sent as an EHF invoice or as a PDF to e-mail. For paper invoices, a fee of NOK is charged. 45 per invoice.
Given that credit has been granted by Norlux AS and nothing else has been agreed in writing, the purchase price is due for payment 15 days after invoicing.
Norlux AS reserves the right to require advance payment or bank guarantee. When ordering special products, Norlux AS reserves the right to require advance invoicing before production.
If payment is made after the due date, interest will be charged at 12% pa.
Environmental fee
Norlux AS is a member of RENAS, which is responsible for the collection of EE waste, and all goods are charged with an environmental fee in accordance with the rates applicable to electrical items at any given time. The fee appears as a separate line in the invoice and is subject to VAT. For the customer, this means that light sources and luminaires can be delivered free of charge to one of the collection points RENAS AS has established in Norway. Shipping and delivery
Unless otherwise agreed, EXW (Incoterms 2020) applies at the agreed place or as specified in the offer. Express deliveries/courier are agreed separately with the customer.
Except when the goods are collected from our warehouse EXW by agreement, a shipping surcharge is calculated on the net invoiced amount:
Zone 1 – Eastern Norway 3.5%
Zone 2 – Southern Norway 4%
Zone 3 – Western Norway 4.5%
Zone 4 – Trøndelag 4.5%
Zone 5 – Northern Norway 6.5%
Zone 6 – Svalbard 9%
The scheme is based on NELFO's current rates with 0 points in Oslo. For any express shipments, freight surcharges must be agreed separately.
For all deliveries, 1% is calculated in transport insurance. Freight and transport surcharges appear as separate amounts on the invoice.
When selling goods to customers outside Norway's borders, the actual shipping cost/expenses will be charged, unless otherwise agreed.
When shipping poles, masts and foundations, the customer is responsible for unloading the goods. If a crane truck is to be used when delivering goods, this must be ordered in advance. Costs for using a crane truck are invoiced according to current rates from Vik Ørsta/manufacturer.
Norlux AS is not responsible for delivery delays due to force majeure, including war or war-like action, government restrictions, trade war, fire, strike, lockout, ban, pandemic, or other similar event.
Delays for such reasons do not give the buyer the right to withdraw their orders, cancel delivery agreements and contracts or make claims for compensation of any kind.
In all other cases, Norlux AS' liability for damages as a result of delay is limited to 10% of the purchase price excluding VAT.
The customer is obliged to check and note any transport damage and shortages in the delivery to the carrier and Norlux AS upon receipt. The waybill must be noted by the driver and recipient. Transport damage and shortages that should have been discovered during such an inspection cannot be claimed later.
When making a comment, the order or invoice number must always be stated.
Sales pledge
Norlux AS has a sales lien on any delivered goods until the purchase price plus costs has been paid in full, cf. the Norwegian Mortgage Act, sections 3-14 to 3-22.
Return
Norlux AS reserves the right not to accept returns. Special designs/non-ordinary stock items cannot be returned.
Returns of goods must be agreed in writing and must take place within 90 days of delivery. The returns form on our website ( https://norlux.com/kontakt-oss/returskjema/ ) must be used when processing returns. Goods that are not sent in accordance with the return agreement will not be credited. Goods received without return acceptance will be returned to the buyer at the buyer's expense and risk. Shipping surcharges are calculated according to shipping zone.
Upon acceptance of the return, stock items will be credited with 80% of the net invoice amount. Reception costs will be charged at NOK 500 excluding VAT.
When returning poles, masts and accessories from Vik Ørsta and similar, salable hot-dip galvanized products and foundations can be returned. A return is credited with 80% of the net invoice amount. Powder-coated products in standard RAL color are credited with 70% of the invoice amount.
In the event that the return is due to an error on Norlux AS's part, no return fee or reception costs will be charged.
Returns must in all cases be made in the original packaging with an attached and completed returns form marked with the order number or invoice number. All goods returned must be free of tape and the customer's own labels or inscriptions. Returns are made at the customer's expense and risk. Any defects or errors with returned goods will be charged to the customer.
Special products, as well as products not in stock, are not credited.

Extended 5-year warranty
Norlux AS' liability for manufacturing and material defects applies for 5 (five) years from the date of delivery.
For batteries, the warranty only applies for 1 (one) year as these are to be considered consumables.
Complaints
Norlux AS' liability for defects/warranty is limited to defects that are a consequence of manufacturing/material defects, as well as transport damage until the transfer of risk, and otherwise in accordance with what follows below.
Any claim must be reported to Norlux AS and documented within 3 days after the matter was or should have been discovered. The order or invoice number must always be stated when making a complaint.
The right to assert a defect is lost if the customer does not, within 5 days after the defect was or should have been discovered, give Norlux AS written notice stating that the defect is being asserted and what type of defect it is. Norlux AS' liability for defects is in any event limited to one year after delivery.
Upon receipt of the notification, the case will be assigned a complaint number. This number is used in all correspondence with Norlux AS. Allocation of a complaint number does not imply that the claim has been accepted, and Norlux AS reserves the right, at any time, to enforce the provisions of these sales and delivery terms and conditions, including the fact that it has been reported too late.
Defective parts will be repaired or replaced with new ones upon return to our warehouse. Troubleshooting in the system or costs of dismantling and reassembling materials supplied by others than Norlux will not be covered.
Norlux AS disclaims any liability under any circumstances for:
- Costs for troubleshooting in facilities
- All forms of indirect loss and in any situation, including business interruption, deprivation, lost profits and consequential damage
- Faults caused by incorrect use and/or installation
- Products that are installed under conditions other than those intended and/or described in the installation materials
- Products used in temporary facilities
- Faults that occur as a result of extreme influences such as severe storms, fire, lack of ventilation/overheating, water ingress and/or other special conditions beyond the control of Norlux AS
- Components that cease to function as a result of normal wear/use, including light sources, ballasts and drivers
- Products that have been opened/attempted to be repaired by unauthorized personnel
- Events that must be considered maintenance activities
- The system must not have been connected to construction power or any other form of temporary power. This point can be waived if an isolating transformer is connected upstream of the light fixtures.
- Warranty on batteries in connection with emergency lighting systems, wireless switches and other electrical products.
- Failures caused by compatibility issues between the products, installation and integration environment, e.g. control system and power supply.
Regarding errors in control systems, e.g. Dali; Norlux AS does not cover troubleshooting, programming and/or reprogramming in the system unless errors have occurred as a result of errors - and/or deficiencies in equipment supplied by Norlux AS.
In the event of errors for which Norlux AS and/or the company's suppliers are responsible, Norlux AS/the supplier has an unconditional right to rectification.
The method of repair must be clarified with Norlux AS. Norlux AS reserves the right to carry out repairs itself.
Claims work carried out on site will be reimbursed by Norlux at an hourly rate of up to 700,- NOK when this has been agreed in writing in advance. Coverage is limited to NOK 700 per product. When the cost exceeds 3,000,- NOK excl. VAT, a cost estimate from the installer in writing and prior approval from Norlux AS is required before the work is started. Any repairs carried out on site at the customer's request will only be paid by Norlux AS when this has been approved before the repair takes place.
If a customer of Norlux AS requests parts, including ballasts/drivers, to be replaced and it later turns out that these are fully functional, Norlux AS will invoice the time spent and the price of the parts.
Norlux's total liability, including liability for defects and complaints, and regardless of whether the contract is terminated or not, shall be limited to 70% of the net invoice amount.
When selling from Norlux AS to consumers, the aforementioned provisions on complaints and other conditions apply with the limitations that follow from the mandatory provisions of the Consumer Purchase Act, cf. Section 3, first paragraph. The Consumer Purchase Act can be found, among other things, at www.lovdata.no .
Intellectual property rights
The customer acquires a limited right to use project material for the intended use in the relevant project upon purchase. Norlux AS retains ownership and all other rights to designs, drawings and technical solutions, including but not limited to lighting plans and lighting design. Use, copying or distribution of project material for purposes other than the intended use by the customer is not permitted.
Venue
Disputes that may arise in connection with purchases covered by these terms and conditions shall be resolved amicably, and otherwise shall be handled according to Norwegian law and at Vestfold District Court as the agreed venue.
